Terms of Service
Welcome to the official website of Monarka Acabados y Recubrimientos, S.A. de C.V. (“Monarka”). By navigating this site or requesting our services, you agree to the following terms and conditions governing our commercial relationship.
1. Scope of Service
Monarka specializes in high-performance industrial coating solutions. Beyond product application, we provide an integrated technical system that includes:
Technical Substrate Assessment: Professional evaluation of surfaces.
Expert Consulting: Strategic guidance backed by over 30 years of industry experience.
Execution and Application: Coating system installation adhering to international standards (e.g., ICRI).
2. Proposals and Estimates
All quotes issued by Monarka are based on technical data provided by the client (industry type, traffic volume, chemical exposure) and, preferably, an on-site physical evaluation.
Validity: Proposals have limited validity due to market fluctuations in industrial raw materials.
Scope: Services are strictly limited to the details outlined in the proposal accepted by the client.
3. Client Responsibilities
To ensure that “Quality Builds Partnerships,” the client agrees to:
Accurate Data: Provide truthful information regarding facility conditions.
Access: Facilitate site access during agreed-upon working hours.
Site Preparation: Comply with pre-installation requirements (cleaning, clearing spaces, etc.) as specified in the service order.
4. Warranty and Quality
Limited Warranty: Our systems include a limited warranty against application defects, provided that usage and maintenance recommendations are strictly followed.
Exclusions: Monarka is not liable for damages resulting from substrate misuse, natural disasters, or structural changes to the building unrelated to our intervention.
5. Intellectual Property
All content on this website—including logos (the contemporary Monarka King), project photography, technical texts, and proprietary methodologies—is the exclusive property of Monarka Acabados y Recubrimientos, S.A. de C.V. Unauthorized reproduction is strictly prohibited.
6. Technical Integrity and Ethics
We reserve the right to decline projects that compromise our technical integrity or team safety. If we determine that a requested system is unsuitable for the client’s actual environmental conditions, we will communicate this transparently, prioritizing the correct technical solution over the sale.
7. Limitation of Liability
Monarka is not responsible for installation delays caused by force majeure, adverse weather conditions (e.g., excessive ambient humidity), or the client’s failure to prepare the work area.
8. Post-Sale Follow-up
As part of our commitment to excellence, we perform a technical audit two to three months after project completion. The client agrees to allow this supervision to ensure optimal system performance.
9. Governing Law and Jurisdiction
For any legal disputes related to our services, both parties submit to the laws and courts of Monterrey, Nuevo León, Mexico, waiving any other jurisdiction that may correspond to them.
